CHILLSWIM CONDITIONS OF ENTRY

AGREEING TO THE T&Cs:
The mandatory tickbox on the entry system stating “I agree to abide by the Terms and Conditions of entry to this event…” confirms that all entrants have agreed to the following conditions of entry

CONTACT DETAILS: 
Important updates regarding the events will be emailed to the contact email address provided at the point of entry. All entrants must keep contact details up to date in the entry system, if any communications are missed due to incorrect contact details Chillswim cannot be held responsible.

COOLING OFF PERIOD:
A full refund of the entry fee minus a £5 admin charge is available for a period of 48hrs from the point of entry n.b. the refund will not include any booking or insurance fees charged by third party suppliers that provide these services.

REFUNDS:
After the cooling off period has expired there are no further refund options.

BOOKING REFUND PROTECTION:
‘Booking Refund Protection’ provided by XCover is available to purchase at the point of entry. If purchased the insurance will provide entrants with a refund on any unused booking if they are unable to attend the booked event due to any of the circumstances covered – CLICK HERE for further information.

DEFERRALS/TRANSFERS:
After the cooling off period if an entrant wishes to Defer an entry – a credit voucher will be provided for use towards an entry to another Chillswim event taking place in the current or the following calendar year. The voucher “value” will be equal to the entry fee paid (n.b. not including booking or insurance fees). Entrants also have the option to Transfer an entry to another person.

DEFERRAL/TRANSFER CUT OFF:
Deferrals/Transfers are available up to 14 days prior to the scheduled event date. After this time Chillswim are fully committed to the costs for each entry and hence no refunds, deferrals or transfers are possible.

HOW TO CANCEL/DEFER/TRANSFER:
All requests for refunds, deferrals or transfers must be made in writing by email only (not via social media or by telephone, etc). Please send all requests via email to info@chillswim.com.

GUIDED SWIMS:
For Guided length of lake swims the £200 deposit paid to secure the date is non refundable under any circumstances. This is due to the fact that the Boat Pilot will allocate a full day to the swim and will therefore be unable to take on any other work – in order for us to secure the Pilot’s availability the deposit will be retained to cover these costs if a swimmer is unable to attend on the date booked.

SWIM CANCELLATION:
If Chillswim are unable to hold the planned swim event or any contingencies on the chosen date due to circumstances beyond our control we will attempt to rearrange the swim at the earliest possible date. If this is possible your entry will be valid for the rearranged date but if circumstances beyond our control do not allow for this then Chillswim has no responsibility for any costs incurred. We hope that you would still be able to travel and enjoy the area in which the event was planned.

EVENT SAFETY:
For Chillswim Mass Participation Events (not for Guided length of lake Swims) participants must wear a tow-float throughout the swim. This is a safety precaution to help visibility of swimmers in the water n.b. a tow float is not a life saving device and should not be treated as such, swimmers should be prepared to a level to be able to swim the full distance in varying weather conditions – a tow-float will not prevent a swimmer from drowning.

AGE LIMIT: 
Competitors must be 16 years or older on the day of the event unless otherwise stated for a specific event.

MEDICAL CHECK UP: 
Long distance open water swimming can be extremely strenuous – to avoid any doubt in a swimmer’s health and fitness we recommend that all entrants should undertake a medical check-up with an appropriately qualified medical professional before attempting any Chillswim event. If entrants have been ill or have experienced a change in wellbeing or physical state (such as pregnancy), please ensure to consult a Doctor before taking part.

GUIDED SWIMS MANDATORY MEDICAL:
For Guided Swims (n.b. not for mass participation events) a formal Medical check is mandatory. This must include an ECG and the medical must be approved and signed by an appropriately qualified medical professional with a clearly stated reference to the intended Guided Swim – the approved/signed medical should be emailed to info@chillswim.com no later than 4 weeks before the Guided Swim, please do not post hard copies.

TRAINING FOR OPEN WATER: 
All Chillswim entrants must commit to training in open water before participating in any event. It is the responsibility of all entrants to ensure that they are fully prepared and Chillswim cannot be held responsible for any lack of preparation. During any open water length of lake swim participants may encounter varying conditions such as waves and choppy water. Swimmers should be prepared for varying types of weather by undertaking regular outdoor swimming.

During the event all swimmers must follow and comply with the instructions given by safety staff including the appropriate distance to swim from the support boats. This includes instructions after the swim has started n.b. events may be halted at any point due to reasons beyond our control such as (but not limited to) lightning, bad weather or a serious incident during the event.

NON COMPLIANCE: 
We reserve the right to remove swimmers from the event for the safety of themselves, other swimmers, staff/crew and/or the event’s integrity. This includes (but is not limited to):
a) Swimming in the place of another swimmer without transferring the entry resulting in the event entry details being incorrect for the participant.
b) Causing offense to any staff member or another participant.
c) Appearing to be ill or under the influence of drugs or alcohol.

EVENT CHANGES:
Chillswim has the right to alter the timetable and structure of events up to and including the day of the event. The route and direction of the swim may be altered depending on the prevailing wind direction.

USE OF IMAGES:
Chillswim reserve the right to use images on print and digital media of all swimmers taking part in the event.

LIABILITY:
Chillswim will not be liable to entrants for the following:

a) Loss or theft on or around the event site, the lake and the car park
b) Any loss of fundraising money due to non-completion of the event for whatever reason
c) Injury or sickness due to the participant’s negligence
d) Failure to complete the swim distance
e) If a swimmer is slower than the agreed time limit and the cut off time for the swim is reached. We need to keep our boat pilot’s safe, to keep you safe. Details of each time limit is on each event and entry page, where applicable.

These Terms and Conditions are governed by English Law and the English Courts shall have exclusive jurisdiction in relation to them
