CHILLSWIM CONDITIONS OF ENTRY

AGREEING TO THE T&Cs: By ticking the box on the entry system stating, “I have read and agree to the terms & conditions of entry”, you have agreed to the following conditions of entry:
CONTACT DETAILS:
Important updates will be emailed to the contact email address provided on entry, you must login to update your details if there are any changes to your email and personal details.
REFUNDS:
Entry fees are non-refundable and non-transferable. No refund or entry can be carried over into the next year. Please see the terms below;
CANCELLATIONS:
In the event of a participant cancelling their entry please note that cancellations can be made in writing by email only (not via social media or by telephone, etc). Please send all cancellations via email info@chillswim.com.
The terms of cancellation are as follows:
- Cancellation 90+ days before event date = 75% refund – excluding deposit*
- Cancellation 60-89 days before event date = 60% refund – excluding deposit*
- Cancellation 30-59 days before event date = 50% refund – excluding deposit*
- Cancellation 20-29 days before event date = 25% refund – excluding deposit*
- Cancellation less than 20 days before event date = nil refund*
*Please note that for Events or Guided Swims, when you are within 20 days of the event, we will be unable to reallocate your place in the event no matter what the reason for withdrawal. For Guided length of lake swims, the pilot will have allocated a day to your swim and will have turned down other work in order for us to secure his availability. Thanks for your understanding. The deposit will be held as compensation for administrative and management time spent, entry system design and cost etc.
SWIM CANCELLATION:
If we are unable to hold the swim or any contingencies on the chosen date due to circumstances beyond our control, Chillswim will attempt to rearrange the swim at the earliest possible date and if this is possible your entry will be valid for the rearranged date but if circumstances beyond our control do not allow for this then Chillswim has no responsibility for any costs incurred. We hope that you would still be able to travel and enjoy the area in which the event was planned.
EVENT SAFETY:
For Chillswim Mass Participation Events (not for Guided length of lake Swims) participants must wear a tow-float throughout the swim. This is a safety precaution to help visibility in the water. It is not a life saving device and cannot be treated as such. It is up to the individual to be able to swim the distance in varying weather conditions, as a tow-float will not prevent a swimmer from drowning.
AGE LIMIT:
Competitors must be 16 years or older on the day of the event, unless otherwise stated for a specific event.
MEDICAL CHECK UP:
Open water is a strenuous exercise. To avoid any doubt in your health and fitness, we recommend that you should undertake a medical check-up with your GP. If you have been ill or have experienced a change in your wellbeing or physical state such as pregnancy, please ensure you consult a Doctor.
GUIDED SWIMS MANDATORY MEDICAL:
For Guided Swims only a formal Medical check is mandatory. This must include an ECG test and the medical must be signed by your GP, state reference to your intended swim, and be uploaded onto the entry system no later than 4 weeks before your Guided Swim. Please do not post hard copies to us.
TRAINING FOR OPEN WATER:
All competitors must train in open water before participating in the event. It is your responsibility to make sure that you are fully prepared and the event organisers cannot be held responsible for any lack of preparation on your part. When open water swimming down the length of a lake you may encounter varying conditions such as waves and choppy water. You should be prepared for varying types of weather by regular outdoor swimming.
During the event all swimmers must follow and comply with the instructions given by safety staff including the appropriate distance from the support boat. This includes instructions once the swim has started, where the event may be halted due to reasons beyond our control such as, but not limited to: lightning, bad weather, or a serious incident during the event.
NON COMPLIANCE:
We reserve the right to evict you from the event for the safety of yourself and/or the events integrity. This includes, but is not limited to:
a) Taking someone else’s entry, so the event does not have the correct details for the participant.
b) Causing offense to any staff member or event participant.
c) Appearing to be under the influence of drugs or alcohol.
EVENT CHANGES:
Chillswim has the right to alter the timetable and structure of the events up to and including the day of the events. The route and direction of the swim may be altered depending on the prevailing wind direction.
USE OF IMAGES:
Chillswim reserve the right to use images on print and digital media of you taking part in the event.
LIABILITY:
Chillswim will not be liable to you for the following:
a) Loss or theft on or around the event site, marina and car park
b) Any loss of fundraising money due to your non-completion of the event for whatever reason
c) Injury or sickness due to the participant’s negligence
d) Failure to complete the swim distance.
e) If a swimmer is slower than the agreed time limit and the cut off time for the swim is reached. We need to keep our boat pilot’s safe, to keep you safe. Details of each time limit is on each event and entry page, where applicable.
These terms and conditions are governed by English Law and the English Courts shall have exclusive jurisdiction in relation to them
